The Bureau of Internal Revenue released the final draft of RA 9504’s Revenue Regulation. Dated August 5, 2008, this outlines the IMPLEMENTING RULES AND GUIDELINES OF RA 9504. So far, the BIR has released the second draft of REVENUE REGULATION following the first one dated sometime June 2008 and after public deliberations on July 1, 2008. This second draft released recently is believed to be ultimately enforced as the implementing guidelines of REPUBLIC ACT 9504.
This post shall focus more on the implementing guidelines affecting withholding of compensation and taxation of purely compensation income earners. In pursuance to REPUBLIC ACT 9504 or The Republic Act amending the National Internal Revenue Code Relative to the Withholding of Income Tax on Compensation, minimum waged income earners are exempted from withholding taxes and ultimately income tax. However, unlike the original draft revenue regulations of RA 9504, there is no threshold amount, other than minimum waged earners, that is exempted from withholding taxes. Minimum Waged Earners are defined on RA 9504 as those employees receiving the Mandated Minimum Wage of a locality by the Labor Department. Compensation Income for purposes of RA 9504 includes the employee’s basic pay, overtime pay, holiday pay and night differential.
As feared by many accountants, the implementation of the NEW PERSONAL AND ADDITIONAL EXEMPTIONS are to be appropriated to a period of six months over the entire year and will therefore effectively cut the amount to half of what was provided in RA 9504 for the year 2008.  For the PERSONAL ALLOWABLE DEDUCTION, Php.25,000.00 is to implemented while Php.12,500.00 for the ADDITIONAL ALLOWABLE EXEMPTION. It is to be noted that Php.50,000.00 is allowed as PERSONAL ALLOWABLE DEDUCTION while Php.25,000.00 for each QUALIFIED DEPENDENT up to four (4).
A transitional withholding tax table is to be used for purposes of computing withholding taxes beginning July 2008, as presented Here

to Jonah, there is no need to apply. One however has to update his/her tax information for the new tax exemptions to be applicable. I shall be writing a topic about the requirement of RA 9504 on a separate post. drop by again this site from time to time.

computation and the taxability of 13th month pay remains the same. As long as the 13th month pay of an employee is does not exceed 30,000, it is exempt from withholding taxes and income taxes.

sir/mam ask lang if how much ba talaga ang dapat na sahod ng isang tao sa 1 yr na exempted na tlaga cya magbayad ng tax…. 200,000 below ba? kasi sa news dati pag ang sahod mo is below 200, 000 thousand a year exempted.

i wanted to find out the implementing rules on individual tax payers particularly the senior citizens. does the new law provide an implementing rules on the above mentioned individuals?

The BIR will subject all individuals, regardless of age, to income taxes. As long as the person generates income, the individual will be subject to income taxes.
